Selling a House As-Is in Florida: What Sellers Should Know

Florida homeowner evaluating an as-is sale and property condition

Selling “as is” generally means the seller is not promising repairs, but it does not eliminate disclosure duties, buyer inspections, financing conditions, or negotiation. Contract language and state requirements matter. Sellers should understand the specific agreement and avoid treating “as is” as permission to conceal a known issue.

Current Eaton listing choices: Florida and Texas sellers can choose $99 MLS Basic for essential seller-managed MLS entry, $499 FSBO Plus for more flexibility and support while managing the sale, or 1% Full Service for broker representation from pricing through closing.

What to organize before listing

Item Why it matters Seller action
Known-condition records Support accurate disclosure Gather reports, repairs, permits, and claims
Current competition Influences as-is pricing Compare similar condition and location
Buyer financing May impose property requirements Evaluate loan type and contingencies
Inspection language Controls buyer rights and deadlines Read the actual contract
Requested credits or changes Affect net and risk Compare the complete offer

A practical preparation sequence

  1. Document known conditions and prior repairs.
  2. Complete required disclosure preparation with professional guidance.
  3. Decide which low-cost safety, access, or presentation items still make sense.
  4. Price for condition and the likely buyer pool.
  5. Evaluate cash and financed offers on net, contingencies, and closing reliability.

As-is does not always mean “no negotiation”

A buyer may inspect and then proceed, cancel if permitted, request a price change, or seek a credit. The seller can respond according to the contract. Strong preparation helps the seller decide without making rushed promises.

Use facts—not promises

Give buyers accurate property-specific information and supporting records when available. Avoid predicting insurance terms, appraisal outcomes, repair costs, tax results, loan approval, or closing dates. Qualified professionals should evaluate technical, legal, financial, and title questions.

Choose the level of listing support you need

Option Included Seller responsibility
1% Full-Service Seller representation, pricing guidance, MLS input, showing coordination, offer review and negotiation, and contract-to-close support. No upfront listing fee; the fee is paid only if the property sells. Cancellation is subject to the listing agreement. The seller supplies property photos and makes property-specific decisions.
$499 FSBO Plus MLS input and exposure only, without representation. The seller supplies photos and handles calls, showings, offers, negotiations, contracts, disclosures, title, and closing.

Buyer-agent compensation is separate from either listing option. It is optional and negotiable, and the seller chooses what, if anything, to offer. Read the buyer-agent compensation guide.
